Wills & Estate Planning

Duncan, Holland & Fleenor provides estate planning for our clients, which includes preparation and execution of wills, testamentary trusts, revocable and irrevocable living trusts, living wills, and powers of attorney for contracts and health care.  We also recommend a basic evaluation of your estate in order to advise how assets may be held for easy transfer without the necessity of probate. We can plan an initial consultation, after which the clients, having full information, can then choose cafeteria-style which documents are right for them. Our goal is to prevent questions or disputes, and ultimately to prevent litigation and to provide for the most expedient transfer of estate assets from the decedent to his or her heirs. We also advise our clients on how to hold joint assets so that the will will often act as a mere safety net, with most of the estate passing automatically without the necessity of probate.

Your will can be as simple or as complex as you prefer, but some degree of simplicity is usually the goal. Still, if the client has minor children, a testamentary trust will be required to make sure the trustee can administer the assets on their behalf. The parents may also want to designate a guardian preference, which may or may not be the same as the trustee.
